My spouse's I-94 expired on May 14th, and I applied for H4 extension on premium on May 10th, but unfortunately it was rejected stating that "Phoenix lock box is not for premium processing" and when I looked at USCIS website in details, there is no premium process for H4 extension. Hence I resnet the application to the same phoenix lock box by removing the premium MO and respective form on May 19th. via USPS mail to Phoenix lock box, which was delivered on May 20th in USPS po box of USCIS. However, I have not yet received any acknowledgment receipt from USCIS, and it has been more than 30 days. In this scenario, I would appreciate your guidance on the best course of action to ensure they remain in the USA legally.
Should we wait until we receive the acknowledgement receipt or decision from USCIS, or would it be more advisable for them to travel to India to get their visas stamped and then return to the USA?
Thank you.
