I am a new member to this forum, please help me with my query below.
Below is my Employment and "Stay in the US?" History
H1B (Company X)Period: March 25th 2001 - 15th Oct 2003 Date entered into USA: Sep 9th 2002 (No W2 was ever generated for 2002)
Was on Bench Until July 6th 2003, after that I got a long term project.
Based upon the July 6th 2003 to Sept 2003 paystubs Company X applied for my H1B extension with was approved by the USCIS. (2003 W2 Amount: 15263)
H1B Extension(Company X Technologies)Period: 16th Oct 2003 - Sept 5th 2006
during this period on Sept 1st 2004 I Was offered a full time Job @ Company Y and decided to take it, I provided Company Y with the 6 months (company X) paystubs and they processed my H1B without any issue. I started working with Company Y only after they received my H1B receipt number on Oct 5th 2004 until that time I was working with Company X on their H1B. I had also provided Company X with a 2 Week notice that I will be leaving as soon as Company Y receives my H1B transfer receipt number.
(2004 W2 Amount: above 45K)
(2005 W2 Amount: above 55K)
(2006 W2 Amount: above 55K)
(2007 W2 Amount: above 55K)
H1B (Company Y)validity: Dec 7th 2004 - Oct 3rd 2007
Then I went in March 2005 to Ottawa Canada and with 2003 W2,2004 W2 and 6 months paystubs and got my company Y H1B stamped without any issue.I came back into USA and took leave for 1 month and went for vacation to India.
I also went to India again in July 2006 for Vacation and came back in August on the same Company Y H1B.
Company Y applied for my Labour in Sept 2006 which was approved.
Company Y applied for my I-140 approved in June 2007
Company Y applied for my I-485 and wife based upon the July current Bulletin.
Questions:
1)Will I get a RFE to prove why I was not paid during the period (Sep 9th 2002 - July 6th 2003)
2)How will this affect my recently filed I-485 application with the USCIS?
