Being harrassed by my lawyer!!!

Hi guys,

I\'m having trouble collecting my original copy of 485 approval notice and my immigration file from my lawyer. He wants me to pay him more money on the grounds that his work load increased due to the responses he gave to a few of my emails during the cource of my GC application. I needed to travel out of the county after i applied for my 485 application and wanted to clarify if it was safe to do so and had emailed him a couple times during the process. He had not adviced of any additional fees that i would be charged if i asked him for legal advice for my GC or for asking him questions, hence i declined to pay him for his unreasonable demand and now he is using it against me by holding on to my original approval notice. I\'ve already gotten my PP stamped with the courtesy copy. If any of you may have had similar experiences, please advice what can be done to get my file back from him and my original approval. Your help is appreciated.

Good luck

I processed my GC

through my company lawyers. I never really pushed to get the original approval (I fail to see the use of it) notice, and I haven\'t found a need to ask for my file. They gave me once a folder about the H1 application, but didn\'t give me anything for I-140, 765, AP, AOS. I made copies of every document they sent me for signature, so I am fine in the sense of having a copy of the original applications. Still, I fail to see why you are so worried about not getting those files. You have already stamped.

If on the other hand you really want those documents, you can actually pay them or fight with them. I don\'t see any other choice. It looks like if you pay them they\'ll give you the docs. If you fight them, you may get the docs or not, and spend quite some time. If you can not reason with them I guess you\'ll have to pay.

My 2 cents.

The lawyer normally will send a copy of i-485 notice which should serve your purpose

I never saw any originals. All I got was copies of everything.

You can fire your attorney by notifying the INS.

After that, you can call INS and request a duplicate of the I-797 approval notice. But I don\'t see there\'s a need for the original notice since you have already got your passport stamped.

Besides, if you are really mad at your attorney and feel that what he is doing to you is unethical, file a complaint with the bar.

Me neither. Never saw original approval notice. It doesn\'t matter. So don\'t spend any more of your time and money on it.

Thank you all for your response. Well, i wasn\'t sure if one must have a copy of his/her docs, \'cause like huracan said, at the time of H1 i had received a copy of the entire file submitted to the INS, hence i was a bit nervous. In anycase, you guys helped me clear my doubts and am not worried any more. I guess i really don\'t need to have the original copy or the files, so my lawyer can very well keep them and sit on them if he likes. Thanks again guys for your responses.

Good luck

There you go. Be Happy. Let your lawyer get frames for your original files and hang on his office wall. You don\'t care.

Have fun. Be Happy
