Being Abroad while filing I-751

Hello,

My temp green card expires on January 23, 2009. I need to be out of the country between October 2007 and February 2008.

If I file I-751 at the beginning of the 90 day period, is it possible to delay the biometrics until I get back? Assuming I would be approved and receive the extension notice, can I get back in in February with my expired green card and the extension notice?

Any comment will be appreciated.

Thanks.

Your dates don't make sense. Do you mean Oct 2008 & Feb 2009 instead?

Solution

yes, sorry.

This is what I think. Once you apply for your GC renewal, you can go to the local USCIS DO and have them stamp your passport with I-551 stamp. You can also show them your confirmed itinerary/tkt to show that you will be returning back after your GC is expired. This way I am sure they will have to stamp your passport for you to travel. Let's wait for other peoples responses & see if they have to say anything different.

Traveling will not be an issue, but biometrics could be an issue. You can travel on expired card and extension letter without having the stamp. If you feel safer you can get the stamp as well.

If you do not show up to a biometrics appointment then your application can be considered abandoned and thus will be denied.

Depending on your Service Center your biometrics appointment maynot come for a while, but in California Service Center it took me about 33 days from the date I mailed it to my appointment date.

You should be able to move your Biometrics appointment, but how many times is the question. If you are going to be gone for 4 months you might have to move it 3/4 times.
