Before invoking AC21, what if previous employer revokes I140??

Hi Gurus,

I wanted to move to new employer after 180 days of I485 notice recipt.

Problem is that I have entered into agreement that forces me to give notice period of 4 weeks to the current employer for changing to new employer.

Before I join the new employer and invoke AC21, there is a chance that my previous employer may revoke I140.

What are my best options under the situation?

Can ex employer eligible to revoke I140 even after 180 days period?

OR ex employer irrespective of time, can revoke I140?

Is it that I should not give notice period , quit company and join new company and file AC21, even without pay stubs?

Please share your ideas.

Wait until 180 days have been past from i-485 filing. After that the employer might revoke the i-140 but it does not affect you anymore. You will get NOID and then you will have to file ac21 papers or just respond to NOID with info form new job.

Thanks for your quick response.
Is NOID goes to Attorney? The Attorney is from the ex employer side and he may trouble me to get NOID.

Or does NOID comes to us too?
 
Did you filed i-485 yet?
If not get your own attorney. I-485 is your petition not theirs.
This way the NOID will get to your lawyer.
 
File G28 and replace attorney of your choice

If you are in any doubt, file G-28 and replace the attorney with your own choice, then all notifications will come to you promptly. Your ex-employer and his attorney will not be in the loop anymore.
