I need advise, so if United Nations or anyone who is qualified, please provide feedback advise. I have several questions and in a delimma.
a) I am on L-1 and my company filed concurrent 140/485 in May 93. My I140 was denied due edu eval. in Dec 93 and my company attorney filed appeal in Jan 04. Since then it has been sent to AAO and to-date no news of outcome. What should I do? I tried calling BCIS hotline and they said they have no information. My online message for both I140 & appeal states it is under review. I tried to get my company attorney check on this & he does not even bother to reply. The only time he replies my mail is (I suspect) he has some forms or documents that needs my signature or action, so that he can start billing my company. My appeal is nearly 15 months now. My L1Bexpires Nov 2006 which seems far away but given the pace at BCIS, I fear I may be running out of time. Can I get my lawyer to change my status to H1 or something so that I can still remain in the country while my case is under review at AAO? What if I can get my status change to L1A? Is that going to improve my chance of getting my I140 approved? Are there any options? What happens if by Nov 2006 and my appeal is still not finalized? What does that mean? Do I have to leave the country and quit my job? United Nations or anyone familiar with the immigration law, can you share your views and offer me sound strategy?
b) I have another job offer that will pay me six figure salary + car Do you think I should quit this job and join this company? What will happen to my current application? Do I have to reapply and wait for the long queue? I know I have to weight my current company's benefits against this new offer and the company's stability. Not good if they offer me 6 figure only to close shop next year. But in the interim, since I have my LC approved and is under AOS, do you think I should even consider joining this company? I have turned down many offers for the last 5 years and this offer is just so tempting. But I want to get my I140 first. And that means passing up on another lucrative offer? I hate the immigration. Why are they making us pay so miserable, when we are here legally and contributing to the economy while on the other spectrum, illegal immigrants seems to get off better than us? United nations, can you share you advise?
