BEC Tracking - for those whose Case Status is/was "Data Review" at one point of time

I am starting a new thread

1) for those whose case status was "Data Review" at one point of time

and

2) for those whose case status is "Data Review" currently....

at any of the BECs.

Please provide -

Priority Date -
Name of the BEC -
New Case Number -
Current Status -

If it is changed from "Data Review" to any other status....did you put any effort to change the status, Or it was automatic?

Here is the tracker file for cases with case status "Data Review". It is sorted based on the PD. The "Comment" column is for logging the way it took to change the case from "Data Review" to any other status.
 
My Status is also " Data Review". Below are my details:

CA/EB2/RIR
PD: Nov. 2002
RD: Nov. 2003
45 -day letter recd: Feb 2005
Case # D-04320-XXXXX
Status: Data Review: (7/10, 8/29)
 
what does this "Data Review" state mean exactly?
I see this in FAQ:
2.Data Review =45day reply not recieved/45day reply not entered
Falls into TR/RIR Q

As I understand there could be 3 cases:
1. 45 days letter not sent yet.
2. 45 days letter sent but there were no reply.
3. 45 days letter sent and reply received but not entered yet.

Am I right in my assumptions?

And why do you need a separate tracker for cases in "Data Review" stage? There is already BEC tracker and I think it is enough.
 
dema, Rallygum & all other guys who have this problem.

Please try to push your lawyer to re-send the response to the 45 day letter. If any of us can get some help by doing that then it will help others to prove the point to the lawyer. I don't think this problem is going away by its own. we have to either pray for some miracle for should do some efforts. I am pushing my lawyer to re-send the response, no help so far.

Case Status: Data Review
Priority Date: 04/17/2003

And then, in the next section, DATA REVIEW, it says:

Date Submitted: 11/24/2004
Date Signed: 03/12/2003

I saw people with Case Status: Final Review.

Does anybody know the difference between these two case status?

Unfortunately, I don't know the date of this screenshot because my lawyer sent me only a copy of it without any information of when he got it.

There is chance that they have not received the response to the 45 day letter or have not entered into the system.

Ask your lawyer to check with them and please do let us know your findings.

Whatever I said is my guess but I am also in same situation. So just don’t take my words for 200%, I could be wrong.

Hi everybody!

I got another screenshot today. It still says

CASE STATUS: DATA REVIEW

I'm really concerned about that because I truely believe D-BEC is starting to approve LCs with priority dates of April 2003, as mine. Therefore, my Case Status should be at least "RIR", if not,"FINAL REVIEW".

There are other guys in my company with the same kind of problem and our cases have pretty much the same PD. :)

What we decided to do now is to put pressure on our lawyer. Listen guys, if we don't do that the lawyer won't do anything. To give you an idea, my lawyer said that D-BEC is now approving cases with priority dates from July 2002 :eek: and therefore my case won't be approved now and blah, blah, blah".

Gosh, he couldn't be more out of date and plain WRONG! :mad: D-BEC
is approving 2003 PD cases!

So, guys, my advice to you all is TAKE ACTION! Go bug your lawyers, remind them that you are the client and it's their duty to go after your interests.

From my part, I'm joining forces with other coworkers in the same situation as mine to try to resolve this impasse as quick as possible.

I am also from MI and one month ago my case status was "Data Review" and I also do not have 45 day letter. I did not get another screenshot
My PD is 11/24/03 and case number is starting with "D-05186". Case sourse says "Region". But fields: Business Activity, Rate of Pay, Occupation code and some others were blank.

Could you provide more details regarding your case ?
1. First Letter and 5 digits of your case number
2. Case Source
3. If your case made to region or not
4. If your new screenshot has all fields filled or it has some of them missing

Are you sure that you have not received the 45 day letter? did you confirm with your lawyer or HR?

Some details with regard to my case: PD : 11/18/03 (MI - EB3). I am an engineer working at one of the big 3 thru a contractor. Got response from Phil BEC. Dallas did not bother to reply inspite of sending them more than 5 emails during the last 1 month.

Last time I got reply (1 month back)from Phil. BEC my Case Status was Data Review", today the reply I got said "RIR"

Do you know what it means...

I would say you have chance not to get 45 day letter at all.
Before they changed status for RIR or TR only when they got all information from Employer (basically response for 45 day letter). Since they filled all of your fields I would say they do not expect anything else . If they did not change anything it will be as I said.

It is a really good sign for you.

The sequence was for case status:

Incomplete -> Data Review -> RIR/TR -> Final Rewiew -> Certified/Withdrawn/Closed.

Congrats with the changing with the next step in BEC

I can only wait and hope that you are right. One never ever knows for sure what is happenning at those BECs.
