I currently have an H4 stamped on my passport till 2009. But, I want to return to India and resume work with a company that I was working for before I came to US in Mar, 2006(I just worked with them for 5 months):
1. Now, if I go back alone and work for the same company in India and apply for an L1 after a year to come back to US(it is an MNC with offices in US), will there be any problem at the consular office because my husband is already in US on an H1(they might see it as a strong reason to not return to India!)? Does that make getting an L1 stamp difficult?
2. If I travel to US on a Business Visa for 1 or 2 weeks for some conference/meeting in this one year will that add risk to my L1 petition?
3. Can I travel to US on B1 at the time my L1 petition is under process and stay here in case it gets approved? Or do I have to go back and get it stamped from the embassy before I can start work. (that way I can go for stamping after 8-10 months when I leave country- I guess that woud increase chances of getting the L1 stamp?)
Any help will be really appreciated guys...I want to take the decision whether I shd go back and try to work with the company in India than staying here on H4 (I did not make it through H1 lottery this year).
