BCIS Website Update

From those of you wondering about the 'real time' nature of BCIS case status updates. My wifes and my I-485's were approved on 5/7/2004. She had a pending EAD application. In Saturday's post we recieved the denial for the EAD (as expected). But the BCIS case status website still says that the case was rec'd yadda yadda. So the case must have been denied a week or so ago, but the webit site still did not update.

I applied for EAD renewal along with wife (primary applicant) on April 15.
My wifes ead was approved and on my case the status showed rfe was sent.
After waiting 12 days, we were ready to call ins as we (or lawyer) never got rfe.
As I was casually looking at the status, i was schoked to see the online status changed to- we received your response to the rfe on -------

I called ins to tell them there must be an error- we never got the rfe , how can we respond. the clerk, as expected said she cannot do anything. the system shows rfe received, all we cna do is wait.

My lawyer has since wroitten to ins expaling the issue. BTW, the case update date changed again yday to June 4 but message remains the same.
Has this every happend- any clues/ appreciated

Wait for some more time ... I think you'll be approved ....

It shows that they are trying to show to somebody that they issued a RFE, you replied to it and they are working strenously on your case and due to this sort of heavy work .... there are so many backlogs but NOT due to their LAZY Ass work .... Hmmm ... interesting ....

Its true, EAD has no meaning after 485 approval. For some unknown reason, I still feel that USCIS is collecting extra revenue from EAD and AP applications to process 485's, for all those who had 2nd FP before an RFE.
If USCIS is sincere enough..., they should return EAD fee for you and your wife instead of denial.
 
I was not complaining about the EAD denial. It is only right and proper that they deny it, because it has no meaning now that we are PR's. All I was commenting on was the fact that we have rec'd the denial notice and the BCIS web site still says 'we recieved' and 'it is taking ?? to process'. I would not expecting a refund as frankly I suspected the I-485 would be approved by before the EAD was required.

I don't believe the added revenue arguement because there was a recent GAO audit on the BCIS, and it was clear from that they have no idea how much anything costs and there operations are not fully funded from the fees charged. So I would argue that it probably costs them more than $120 to process a EAD application.

Please do not misunderstand me. In your earlier message..., your intention was only to mention that the website is not updated in time, that gives a clear picture to 485 waiters who are depending on the website updates....
May be I am wrong is criticizing USCIS that they are collecting extra revenue from EAD/AP applications.
As I am not able to sit and wait for the approval, I started analysing the trackers..., my attention fell on the data EAD applied... 485 application got attention. Then I started looking more closely on 2nd FP done before an RFE, EAD and AP applications are triggering 485 approval or RFE.
I am unable to decide, should we apply for 3rd EAD (5 months to go), or should we wait for 485 approval??
Also update this thread, if the website says anything regarding your EAD denial, so as we could also know the time delay between paper and website...

I know you already know this, but for what it is worth, my advice is, that you cannot afford to fall out of status. What I would do is hold off on the 3rd EAD until closer to the 90 day mark (day 105 say) and then apply. That gives you the freedom to get an interim EAD if you need one. If you get your I-486 approved in the meantime, you have blown the application fee, but at least you have the safety net if it doesn't. I don't see there is a good alternative to this.
 
Paul- did you get a chance to read about my dilema

and to add to the irritation- does the rfe issue prohibit interim ead
 
I don't know for a fact but I have seen other posting saying that the RFE will prevent an interim EAD from being issued.

Depending on whether your wife needs the EAD and when it expires you might want to think about another EAD application.

Today there is one more report regarding website not updated. I think USCIS website is facing some technical problems.
