BCIS going to change EAD rule for I485 applicant

12/25/2003: Agencies' Plan 2004: I-485 Backlog and Issuance of 2-Year Valid EAD (Series 4)

The BCIS has been considering for quite some time to issue a two-year valid EAD for the I-485 waiters in order to relieve itself from the increasing EAD processing workloads as affected by the growing delay of adjudication of I-485 applications. People must have noticed from the BCIS monthly report of immigration benefits petitions/applications that the EAD processing takes a substantial portion of its workloads which have kept growing because of the delays in processing of underlying I-485 applications. The BCIS may issue this proposed regulation soon with the 60-day comment period. This category will be reserved only for those applying for I-485 adjustment of status, or having filed Form I-485. The rule change would give the BCIS the flexibility to issue EADs for the length of time it anticipates that adjudication of a given case will take.
This is a very welcome move. However, one wonders where is the promise to reduce processing times of applications to six months.
 
Good Move!

It is a good move on USCIS. They should have done this long back and lot of people would have avoided applying every year for their EADs year after year and still waiting for the 485 to approve. Question is, would this apply for those who are going to apply new or for renewal or can this be applied to already those who have EADs and getting expired some time in 2004.. Food for thought!

sydney is right. With AP processing times doubling over EAD processing times, why cant they give an AP that is valid for say 3 years in the TSC?

The longer they give, the longer it is going to take for the destination.......
 
Obviously this is a good move!

This will free half of the workload on EAD at TSC so they can focus on other applications such as I485.

Maybe this is a move to counter one of the main points of the class action lawsuit or hopefully the first step in a real backlog reduction plan.

If this happens it will be a big relief for all I-485 filers.

Let's wait and see...

I doubt that CIS moves that fast (in a three day time period from the day the lawsuit was filed to the day this statement was issued). They must have been mulling over the EAD backlogs by several months.
