I just want to share my experience so far with regards to 1-140/I-1485 concurrent filing.
I filed these applications on Dec 17, 2002 for me and my wife.
Got a receipt back from BCIS for these on Jan 26, 2003 with ND of Jan 24, 2003.
Went for FP on Feb 26, 2003.
Received my AP documents in March 2003.
Received Second FP notices in March and was asked to ignore when I showed up at the local office.
Did not receive my EAD after nearly 180 days of applying.
My wife received AP, EAD all on time.
When I contacted the local office for an interim EAD, I was told that some action was taken on March 2003 so I had to wait till Jun to apply for an interim EAD.
Yesterday I got a shock from my lawyer when I learned that the action that BCIS took in March 2003 was to close my EAD case (by mistake) and send it to some storage in Harrisburg.
In the meanwhile my H1B expires soon and can only be renewed for 3 months, and I have to make a decision.
Whether to reapply for a new EAD or to fight with the local office for an interim (If I can put some sense into their minds)? BCIS says that they will request the Harrisburg facility to send it back. God knows how long it will take.
Some of my coworkers who applied along with me have their I-140 cleared. Since I haven’t received mine, I am beginning to think whether BCIS shipped my I-140 and I-485 applications to cold storage in Harrisburg.
Life is getting a bit complicated. But then again, who said it was simple in the first place.
