BC question

I have seen lots of people getting rfe on birth certificate so I want to be prepare for myself, although I am so far in the long queue.

I did not have bc from hospital and I requested municipality to issue birth certificate and my mother submitted affidavit in the court and got the bc from municipality. I have submitted the same with my 485 application and not submitted any affidavit. Would this work or should I have to be ready with my parents affidavits?

Yes

If you have BC from municipality, it will work..
In case on Non-Avail...you have to submit Non-avail letter with 2 affidavits from relatives.

you might wanna check the registration date on the BC, if its of recent years then it won't work. If its of year close to your birth then it will work.

What if your real birthday (from hospital) is different from what's on the passport? The birthdate was once changed to be a couple of years older for school purpose by the parents. Anybody has similar situation? How did you solve the problem?
 
lulx-co in that case u'll have to get 3 affidavits from ur family & not found certificate from registrar/department of death/birth in nagar nigam(municipal) office of ur district/city.
Your affidavits should support the date OB u've reported in ur application & passport.

BC is valid, if issued by municipal coporation.
But questions arise is...
what is the date of registration. There will be 3 dates on a BC.
(1) your birth date
(2) the date your birth was registered
(3) certificate issue date (no problem if this date is yesterday or today)
item number (2) should not be greater than one year from the birth date.
if this is true, next your name should appear on the birth certificate, if not your parents or any person older than 10 years by you who is related to you should be able to support with an affidavit.

I have a birth certificate which has delayed registration but the birth date etc. are ok.
So what should supporting docs should I try to get?
1)I have secondary exam admit card which shows the dob

I have little time to get it. Do let me knowas quickly as you can.

My wife's DOB certificate had a delayed Registration date and this is what INS responded to it(i've used some short acronyms to avid typing time):-
"Since the BC u've submitted to establish ur birth & parentage wasn't executed at the time ur birth allegdly accured. the evidence has insufficient reliability & weight, alone, upon which to grant a visa petition."

This explains that INS won't accpet delayed registration dated BCs.
So your alternatives are very easy to get.
1. 3 affidavits which are discussed million times on this forum.
2. Any doc from school, election commission, Income Tax(PAN), whcih has ur father name. because mother's names are never on any doc in India. may be recently certificates do have I'm 75 born and i don't have such doc.
3. Most important and easy to get copy of ration card, get it translated in english. Ration card has all members of ur family names in it.
4. last page of ur passport where ur parents names are given.

ANd u r all set. believe me i gave them all 4 for my wife's case and it worked. Ur admit card will work with other suppoting docs like Ration card which is primary.

For clarifications,

3 affidavits or 2 from each parent? Who is the 3rd affidavit from..?

Also
1)Driving Licence may be produced along with
2) ration Card
3) or School Final Exam Admit card which has the DOB and Father's Name
4) Last Page of your Passport is always there thank goodness...

Any documet which has DOB or father's name just send it. I did the same thing. I might have produced 7-8 documents.

Thank You amcom. This is really helpful.

I have 2 queries.

1) Parent's names in the Hospital records and those in the BC don't match letter by letter but they pronounce exactly the same. Typical issues in writing complex Indian names in English...Would that be an issue.
2) However, the parents' names match in the Passport with the BC.Problem is the hospital record has been submitted
3) Secondy the name of the city got changed for e.g. from Bombay to Mumbai.But in the hospital record the city name is Bombay(as it is an old one) and the BC has Mumbai Corporation(as this is a new one).Any explanations needed for that?Or they should know about it..
