Battered Spouse

My wife received her Green Card through a Battered Spouse Petition in Oct of 2006. I have been told that she will be eligible for Citizenship in Oct of 2009. I married her after her divorce went through so I have never filed any documents for her because her petition come without the normal conditions attached to it and I didn't want to interfere with her process because USCIS is not known for speed in its applications. She has never worked but has attended school with me being the primary support for her. So I guess I have a couple of Questions?
When can she file for Citizenship 3 or 5 years?
Do I need to file anything for her? We have been married since March 10, 2006 and have one son?

she is eligible to file on July of 09
i'm assuming you are a US citizen.

She does not need you to become a US Citizen, she can do it on her own if she waits 4 years 9 months.

However if she wants to do it sooner, she can file based on her marriage to a US citizen if she can prove she has been married and living with you for the last 3 years after filing. She will be eligible in July 2009.

Yes, I am a US Citizen so she just needs to file the N400 and I show the documents of our last three years together. Thanks for the info

This is wrong info - as a Battered Spouse she can apply after 3 yrs - so July 09. You have nothing to do with her process, she got her GC as a battered spouse not as because she was married to you, USC, so she needs to fill out an N-400 form.

Do some research here and on google you will find the USCIS Memo on Battered Spouse applying for citizenship
