called NSC 10 minutes ago, the lady who answered my phone was very nice when she asked for my LIN number, but after she pulled out my file from the computer, she saw a phone call record made today, from that moment on, she got so pissed off, she asked me whether I made another phone call, of course i didn't, haven't called them for 2 weeks, then she refused to give me any info. and gave me real nasty attitude, must be my lawyer who called, felt so bad after talking to that IIO. :( :confused: :mad:
 
Depends how you look at it !

This could be good news or bad news. The good news is that your lawyer is following up and he cares. The bad news is the blame you are giving yourself. I believe waiting is very hard, the way you are thinking, makes it harder. Just be calm and wait. Believe me, there isn't anything else any of us can do. Hey, cheer up man! Life has much more to it! and remember that good things come to those who wait.

What's your ND/RD? If its Oct 01 or later, then just sit tight. There's nothing much that can be done at present. However, if it is earlier, you can explore several alternatives such as writing a letter of inquiry, getting the help of your local congressperson/senator, or getting your lawyer more involved in the inquiry process.
 
I’ve talked to IIOs around 5 times, experience until yesterday. Despite their title, they never seem to give any information! Yesterday, I talked with a gentleman (and he truly was one) who also adjudicated decisions. I queried about my I765 application based on AOS pending. The I765 has been pending since Dec. 4, 2002! He said it was just recently assigned to an officer to adjudicate (May 18). Another thing he mentioned was that now is a particularly busy time for them since they have tons of EAD application from graduation college students (hey we were in the same situation recently!).

Davli024, as far as the IIO refusing to give you even cursory information, it is unusual and rude. If anyone acted that way in the corporate world, goodbye job. That’s the advantage of working for BCIS. You can abuse your “customers” at will and get away with it. You may wish to write a complaint letter, although I don’t know what good that will do.

my RD is Oct 20th, don't know where to find the ND. the reason that I am so anxious about this is that I will be laid off soon:mad:
my local congress man contacted INS yesterday, and he was told that our cases are still waiting for the security background check.
I saw many posts saying that, kinda suspect that INS just uses this as an excuse so that they don't need to deal with the pressure from senator or congress man. any other way to dig more info.?

relax buddy, it isn't all that bleak. i got laid off after my 180 days and looks like you're well over the 180 days rule so even if you get laid off, your application will not be revoked. in this situation, it works to your advantage if INS does not process your case immediately.

Because if someone picks up your case and decides to send an rfe, you won't have much time to find a new job and hence reply to an employment based rfe with a new employment letter. so it works to your advantage to find another similar job and then have all the materials ready (including your layoff letter) to respond to any possible employment based rfe

fyi, i replied to my rfe the same way i described yours.
 
I talked with an IIO today 05/23..

I called gave my receipt number. He checked and told "I see you called on May 2nd. and what did the officer tell you?" I told "yes, I called and the officer told a decision will be made in 2-3 weeks." Honestly, that is what I was told. He replies in a rude attitude "No, that is not what the officer told you". I said, "yes, that is what I was told..." He asked the question again and I didn't know what to tell other than the truth. I said the same thing again the truth "the officer told a decision will be made in 2-3 weeks and today is 3rd week" he said "bye" and hung up!! Now I am feeling really nervous! Will this jeopardize my case?? This is crazy......I regret calling them...I was better off earlier...
 
you did the right thing. if someone says 2-3 weeks, you have every right to call on the 3rd week. I come from a sales background and i look at it from that point of view.......a client told you a decision will be made by latest the 3rd week and you called to find out what that decision was.

it isn't your problem that a jerk was on the other line. the most he can do is put on record that "applicant calls incessantly". from what i know, that is not an offense where adjudication can be denied or withheld.

thank you for your nice words. it has actully been 19 months since I filed I485, I replied the RFE and INS has received it at 1st week of march. that is why I think my approval should be waiting right outside my door now, unfortunately, they are still hiding somewhere....

as a matter of fact, I am about to get a much better offer, but it is in memphis, I am kinda scared that if my case will not be approved before I leave, it could be transferred to Texas center and it will take forever.... what is your opinion about this? will my case be transferred to Texas center if I leave before getting approved?

sometimes we give INS too much credit. There is no point in creating more paperwork for them by notifying them of your change of employment. If it's been more than two months of your rfe, then you should expect a response any day now.

If we keep it simple for them, the less paperwork they have to go through in each file. hence, unless they come back and send you another rfe regarding employment and paystubs, there's no need to notify or transfer anything. and even if they do send second rfe, you can always respond back with current job offer.

Note: I'm not an attorney and this is just my personal opinion. Before taking any steps, please talk to your own attorney,
