I came to louisville, KY about a year or so back. I have my 485 filed in LA, My LC salary was stated as $X amount. Since coming to KY it was reduced to $X-2 . My company was taken over by another company and now for the RFE they insisit on giving me a letter that says that my salary is $X-2 my lawyer says that I will mostly be rejected. ( Yes, I am still maintaning the LA Address ) So he drafted a letter that says that my compensation will be atleast $X which in a way is true. coz if you add my benefits it will add up to $X+2 for sure. The company is adamant, they say if the word compensation will be used then we will split it up to say ur
basic+benefits+SSSS = Compensation. Damn this assholes instead of helping me out they are trying to split the hair. My lawyer said its an ambiguous word 'Compensation' their ass is covered and so is mine and he has got this kind of letter for a lot of his clients NO Problemo........ every body got approved without question. also the damn difference isnt much its around 4K.

I dont know what to do.

My guess is 4K would not be considered a significant difference. So even if the company insists on its own wording, it should be okay.

What do the other people in this forum feel about it?

minknowledge1,

Terrible to have employers who don't understand the plight of its workers.

But IMO, you should be okay! The "compensation" concept should work. And 4K is insignificant in todays lousy economy and the location shift of your job (LA is way more expensive than KY). That can be a good defence if/when you are called for an interview. Which could be imminent thanks to the change in state.

Good luck, keep us informed!

Agree with extra_dry_gin

The wording that the company insists should be OKAY, ie., if BCIS goes by the spirit and not letter of the letter

Slightly better situation then s-terday

I talked to a supervisor of mine, and he actually couldnt believe that corporate office was really screwing me this way. He told them to write the letter as is from my lawyer or he will just give me a raise to take care of it. WOW. Well i knew this guy could help me and thats y i personally went and met him. He looked like someone who will listen to me and he did.
But i still have not got the letter yet, prolly by tomorrow i will. I will update u guys as & when things move on. hopefully those in similar situation like mine, try to get hold of your superiors and explain to them this problem... yep i did have a decent rappot with my boss if not excellent. But still have to get the letter in hand and see how it goes. but at present it looks very positive. My lawyer insists that if the salary doesnot match wats on the LC u r gone becoz according to BCIS CA i m still in LA and not KY. and my company is the same so the LC has to be honored.
