BackLog Retrogression Rule Not Followed In Nebraska ...

It looks like Nebraska is not following the BackLog Rule that
cases of PD 01/01/02 ONLY will be approved for EB3 Category.
If it follows we won't be seeing any cases of PD 10/10/2003 getting approved
after the backlog started.

During this backlog season if a guy has PD for Labor as Jul-2000
but the I-485 file date was only in Nov'2003 will the case be opended only when the File date becomes current or will the PD of Labor help the case.

PD is for labor. It does not matter when 140/485 were filed. What matters is when the attached (yours own or some substitute) labor was filed.
 
If the Rule was followed we should not be seeing any Approvals later than
01/01/2002 which is not the case .You can see in RupNet guys getting approved who have filed in Sep'2003.

YES. I fully agreed with you.Whats going on with NSC???
 
Once again, guys

PD is the day you applied for labor certification. So if your PD is in 2001 and your I140/I485 is in 2003, backlog does not apply to you.
 
Rupnet approvals with PD after 1/1/02

And I could not find anybody on Rupnet who is EB3 from the affected countries, has a PD after 1/1/2 and was approved after 1/1/5.
