Hi there. I will soon be submitting my I-485/765/130/131 pkg. to my local office. I can't find any info on at what point a background check comes into the picture. I know there are questions on criminal record, etc., but do I need to request a background check from Canada? I know a few people going the K visa route, and they must provide this information at the begining of the process.
I was guessing maybe the fingerprinting stage is when they check your record? But again, I don't know if this is something I should request from Canada on my own.
Finally, one reason I am concerned about this is that I did get a conditional discharge for an offence in Canada a good 5-6 years ago. According to the RCMP, this was purged from my record after 3 years of no trouble. I have requested more info from them, and will ask a lawyer, but was wondering if anyone knows offhand if I have to check "yes" when I am asked if I have ever been arrested?

Well, I plan on sending my prints to RCMP to obatin a copy of my record just in case, but as I mentioned earlier and someone confirmed, there does not seem to be a point where a background check is required. Also, I don't need a pardon, as I had a conditional discharge.
The RCMP Pardon website states : "A person does not need to apply for a pardon if his/her criminal record consists only of absolute or conditional discharges. Absolute or conditional discharges handed down by the court on or after July 24, 1992 will automatically be removed from the CPIC computer system one year (absolute discharge) or three years (conditional discharge) after the court decision. ".
What do you think? I think it sounds like I do not have a criminal record. I know even a pardon shows up, but this sounds as if a discharge that has been purged does not.
Anyone else (Canadian) applied for AOS through marraige to USC using I-130/485/765/131 pkg know if they had to supply criminal record or background check?
