In the Year 2000 I was was summoned for simple assault of an 5 year Old, which i didnt do it, and never admitted and also no one witnessed. I went to court to get it dismissed, the other party never showed so the judge gave me a probation and dismissed the case saying" dismissed upon unadjudication". I am going to apply for my I 485 soon and currently I am on H1 now. I have requested an FOIA from the municipal court where the case was handled, they replied me back saying no record exists and cases more than 5 year old are disposed off.
My question is when i fill up my I 485 do i need to say "yes" or "no" to whether i was convicted etc.
