Background check possible delays

K...Since I filed for my Naturalization and still waiting to hear for 2 years...I am thinking would any of the following might help in the delay process and subsequently lead to denial

1. Suspended license about 16 years ago!. Never was arrested for finger printed
2. Credit card issues from 16 years ago and in default (statue of limitation has even expired on them). Over the last 10 yrs no credit issues
3. Never late in filing taxes. Does not owe anything to the Gov't
4. Went to court only once on a civil matter related to selling of a used car.
5. May have few bounced check from 16 years ago that did not clear.
6. Filed with FBI FOIA...response came out as no record!

any suggestions!!
 
Hi there!

i don't think any of that will lead to a denial of your application. What causes those delays are not actual 'hits' (files pertaining to an applicant), but 'false hits' because they run each name in a multitude of spelling combinations. The more hits (true or false) a name check triggers, the more time it takes to resolve the name check request. Each hit has to be investigated.

Have you been interviewed? If so, how about considering a lawsuit under 8 U.S.C. 1447(b)?

I had my interview 2 weeks ago. I passed the Civics and English test, but the officer said since the background check is still pending a decision cannot be made at this time. However, he was very nice and said I should get the oath letter in 2 months.

How did you know that your name check has cleared? Except for a speeding ticket and a parking ticket, I do not know of anything adverse in my record. I am worried at this point. Thanks.
 
My officer told me that I am going to get a letter to my oath ceremony in 3 monts. I have been waiting for 8 months now. Good luck.
 
yeah 60 days...... 120 days.....6 months.....5 years(accodring to one officer)

I am actually going to file a lawsuit as we speak. I have hired a lawyer to do so. Lets see what the outcome will be.

I have already been interviewed in November of 2004. Since then I have tried Congressman/Senator office.....but always get a typical response pending background check clereance. I am not sure if they actually try looking into the file or just give out their standard response :confused:
