Background Check / FBI Name Check

I want to get a few things clear in my head.

1. Is there a difference between the FBI name check and the background check? Are they the same thing?

2. When does the FBI or background check start? Does it start before submitting the fingerprints?

3. If it doesn't start before submitting the fingerprints, this means that my wife will be in bad shape since she didn't receive her fingerprint notice yet.

Any credible links with answers to some of these questions would be very appreciated :D
 
There are four security checks, my guess is Finger Print Check; Background Check; Name Check and some other check. The name check started as your I-485 was filed and the finger print check started after your first finger print was collected.
 
I could be wrong, but I think the fingerprint check is the fastest check! I hope I'm right because I would hate to think that the checking on my case is being held back until I go to do my fingerprints next month.

1. custom and border check. The USCIS checks wtih its own data. No need to worry about it, if you entered legally.
2. Finger print: for criminal histtory in USA.
3.FBI name/background check: Important and the critical. Without clearence from FBI no 485s will be approved.
4. CIA check: USCIS sends your data to CIA. However, USCIS does not hold it for CIA clearence. If CIA comes with some issues, USCIS may take some action at the time.
5. Consulate: If your non-immigrant visa issued with in less than one year of 485 filing, USCIS initiate this check with the consulate that issued your non-immigrant visa, otherwise not.

3. So the FBI check doesn't require the fingerprints?

5. This shouldn't be a big deal for an H1B visa holder since H1B visa allows for dual intent (Temporary and Permanent). Is this correct?

Well, my question is how do we know whether security checks are being cleared ? Will the status get updated online for the case? How do we find out if they have cleared or pending ?

I've completed Biometrics Code 3 on Aug '05. Since then, i see no online status change at all.

This is very important information. As I understand-
1. Need not to be worried unless somebody is illegal for a while
2. Usually done in one or two days (mine was done next day) after FP
4. Not applicable for us ordinary
5. Applicable only for new comer
3. Is the most unpredictable one. You may get cleared in few days, it may take 120 days, and for 1% people it may take 2-3 years.

No change in the message. It still has the intial message after the submission of I-485 application.

Is Biometrics Code 3 is different from FP notice? I don't know if it is. Also, online message change after Biometrics Code 3 completed ? Any idea? I read in the forums that online message changes ' We have resumed your application process again...........'.
 
I did my code 3 in April 2005..no change in message..only LUD changed when I guess FP report came back. I checked with FBI, the FP report was sent the next day. Applied for EAD and APs.. no approvals so far. Enquiry came with results "under security review" I do not what does that means. Filed under EB1-2, PD-Aug 2003. I-485 filed in Feb 2005. WIth retrogession..I am fairly disappointed. Do not know what to do. :confused:

Do you know if the FBI replies to email inquiries any more? I sent them an email two weeks ago on this email address fbinncp@ic.fbi.gov
 
How to find the status of "background check"?? I was told that my wife's case is pending such a "background check". The weird thing is, NSC had already processed her case and sent out RFE for proofs of a valid marriage. Then, after reviewing her RFE, her case was transferred to local office. I thought that, if there is a pending background check, USCIS won't even process one's 485. Isn't it right?

While you were waiting for your name check cleared, did you get approval for AP or EAD? Or they were stuck too? Thanks for your reply in advance.

It really doesn't matter even if takes 6-7 months for the FBI to reply. Even after FBI sending the reply to USCIS - washington DC, results could sleep in there for years. USCIS system doesn't get updated right away after FBI background/name check. It all depends on sheer luck of the individual.

Hi Mr.Green, I was just wondering if you have letter format for sending for an email to FBi. I wanted to enquire about the my finger prints clearance as well ?

How/when do we know if all these security checks are being cleared ?

There is no specific format. Just provide them with your name, A#, Birthday, address and phone number.

I read somewhere that they stopped responding to email inquiries. I'm not sure if this is true. I sent an email anyway!

How to find the if name check and security check is completed? Any idea guys?
