I\'m in a situation which I\'ll describe, and do intend to speak with a real lawyer. I have been working, as a regular employee since Jan 2001 with a company, based in NYC. We relocated to NJ after being affected by Sept 11.
A lot of us are on H1 and are concerned because we have not received our full time salary for 2001.
Almost since its I started, being paid on time has been a problem, even though we specifically agreed that paychecks would be timely (I know this is already protected under state and Federal law). It\'s now to the point where all of us haven\'t been paid for several (6-9) months. We keep hearing excuses about cash flow; never any claim the salaries are not owed, never any claim that the money is a long term problem. But to me, not being paid for six months IS a long-term problem, even if the CEO has promised to pay all extra expenses (late fees, interest) on the money owed. Of course, I have my doubts about his promises in general.
Clearly I have waited longer than necessary. The main questions are, what and where? I\'m in New Jersey, so is most of the employees. What is my legal claim to unpaid wages. What does the law permit. I know what most of you are thinking - why stay - but we are all commited to the company because we (still) beleive that it will do well.
