B2 visa sponsor document - valid visa stamp vs Approval Notice

Hi

I would appreciate your response with the following question.

My first H1 expired last year (Jan 2003) and I got my H1 extension approval (I-797) notice in Apr 2003.
I haven't gotten stamping in my passport, but just had the approval notice. I am still employed with
the same employer and getting regular pay checks.

I would like to sponsor my in-laws for B2 tourist visa. Do I have to have a valid H1 and I-94 for
sponsoring a B2 visa or Is the approval notice sufficient proof of legal status in USA ?

As long as you do not leave USA, the expired Visa STAMP does not matter. You have to have a valid I-94.
The most recent I-94 is at the bottom of your latest I-797 approval notice. Look at it carefully. It should read something like:
"Please detatch the I-94 and staple it to your passport".
This is your current I-94 and it should be valid.

You are fine.
