Hello everyone,

My in-laws have B2 visa appt. at the Chennai consulate on April 26th. I have been here in the U.S for 6 years. My H1 expired in Dec 2004, I have applied for 7th year extension. I have also applied for green card. My I-485 is still pending. In such case, what legal status I should put in the DS-156 form ?. Which one is better ? H1B or I-485 applicant ?. I know, either way, I need to show them a proof. I thought I-485 applicant will be better because I have the receipt notfice for that. If I put H1B, I don't have a valid visa, all I can show is the expired visa and the receipt notice for 7th year extension.

Please help.

Thank you.

Since you already applied for the H1 7th year extension you would be considered in status as H1 B holder. You may show that information
