B2 Visa extension - please advice

My mom is on B2 visa and her I-94 is going to expire on March 26th. I'm planning to extend her stay here.
She has got only for One year VISA stamped on her passport That will be expire on End of June 2005.

My questions are :
1) I heard that I can apply for a 6 month extension eventhough she has only
3 months left on her VISA (Till June). Isn't that true ?
2) If I apply now, (in CSC), it may take approximately 3-4 months before it
approve. by the time her VISA on the passport will expire. Will it create
any problem ? OR will it make them reject the application ?
3) Does anyone filed e-file in CSC or any other service center ? is it faster
that manual ?

Please advise.

Raj,

I would not advise you to file extension with single entry visa. It might create problems when she goes for VISA again back in India.

I have friend who filed for extension for his MIL. The extension was approved and she stayed for another 6 months extension granted.

5 years later they needed her to come again and went for visa to Chennai. They have refused her VISA saying she has over stayed. Even though she stayed legally on an approved extension of stay. They needed to move heavens and earth to get her VISA again (with a letter from local congressman got another hearing and took a letter from INS that she stayed legally and all that)

It may not happen to you, but why take chance with a bunch of irrational people and crazy processes that they follow.

First of all let me make it very clear, as srps said, if you go for an extension this could be a major problem next time she goes to consulate for a visa. Lets assume you are aware of this, but do not care, I will answer your questions based on this assumption.

--- Yes that is true. You basically apply for extension of her I-94 and so visa validity does not matter.

--Once extension is denied, her status become illegal, and it becomes illegal from the day the I-94 expired, not from the date of rejection. This is not a major problem as long as this illegal time is less than 6 momths. But it will be a problem next time she applies for visa. (again coming back to that point!)

that manual ?

serta2002 has provided the answers that I think are accurate. Efile may be preferable , over manual method. But, that is just my feeling, has no basis in any fact.

Againi, why you want to take chance with single entry visa? If her extension I-539 is denied, it is guaranteed that she can't visit you again (atleast till you get citizenship and sponser her for green card).

My mother has 10 year multile entry visa. I have decided to take chance and applied for extension. RD 02/0705. Efiled the I-539 for TSC. Awaiting decision. My mom's I-94 will expire of Feb 19th. If I-539 is rejected, she will go back immediately. I plan to have her come again on the multiple entry visa. I'm hopiing the I-539 denial (assuming it is denied) will not cause troubles for her when she comes here again.
 
srps, my mom's visa is multiple entry....

my mom's also multiple entry visa. but only thing is they gave only for a year visa. Not for 10 years. If they reject the application, same problem will be applicable to your mom as well as mine. They have to get a new visa all over again doesn't matter 10 year or one year. you have to process it again once it got rejected.

what all the supporting documents we need to send for I539 (for B2 extension) Only the affidavit is okay ? please clarify ...

They have to get a new visa all over again doesn't matter 10 year or one year. you have to process it again once it got rejected.

I have heard conflicting information about what you read on immihelp.com.

If you read some back posts on this forum, some people said that it doesn't necessarily happen. Further more, since the the VISA is multiple entry for 10 years in passport, they will allow her to board the plane in Inida when she visits next time. The INS officer at POE might make an issue, but we are hoping that they will allow her with a warning or something like that.

1) what all supporting documents
2) can I send a personal check for the fee ?

1. A Letter as written by my mom
2. A letter written by me.
3. Notarized Affidavit of support executed by me.
4. Bank balance proof (screenshots+letter)
5. Passport Copies all pages (for mom)
6. I-94 copy (both sides)
7. Copy of return ticket

Its for 6 month validity ticket. How can I take a ticket when there is no guarantee that it will get approve ...
