I was working in US on H1b and had to go out of US. Now i have returned to US on a B2 visa. I would like to use the reminder of my time on the existing H1b. I was out of US for 9 months and now in US for 3 months. If i have to apply for the Non-quota H1b, should i have to apply before 1 year is completed from the time i left US last year or since i am in US now, that rule does not apply.
Please advice.
