B2 to E2

Hello,

My compay wants to set up a company in the US and sent me with B2 visa and I set up the company ( office). It has been 6 months since I set up everything and I am the CEO at this company in the US at the moment however my comany keeps delaying to get E2 visa but wants to start to sell the products as soon as possible. Let say if company decide to close the office in the US after some products had been sold like 3-4 months later is this going to be okay? I mean am I okay legally?!?!

Are you currently in the U.S. pursuant to a valid visa?

Once you are in valid E-2 status and the sponsoring company closes, you will becomes out of status. In order to avoid this, you should change your status beforehand. I am not sure if you are currently in the U.S. or abroad? Why would the company only open for 3-4 months? It doesn't make sense to go through all the trouble of setting up the company, marketing products, applying for visas, etc. just to close.
