B2 pending to H1b

B2 *pending* to H1b

Hi great guru,

My friend is transferring from F1 to B2. She submitted her application in Septmember and currently is still in B2 pending. She just got a job offer and wanted to transfer to H1b. Should she wait for the B2 approval and then apply for H1b? Is it riskier transfering from B2 pending to H1b than transfering from B2 to H1b? There is only about 3000 left in 20,000 advanced degree quota so she wouldn't like to wait for the B2 approval.

One lawyer told her there would be only 50% chance if transfering from the pending status. Is it true?

if possible why dosent she just travel to India and wait for H1 there. Then get the stamp and come, travelling to India will nullify her B1 COS as well.

hi, may I ask you something? Hope everything will work out for her. Actually I need your help and advice. I am kind of in a similar situation..I want to apply for a change of status from F1 to B2. Did she apply for a change from F1 to B2 without leaving the US? Did she use the form I-539? I called the USCIS and they said I cannot change from F1 to B2. They said I have to go home and apply the B2 from there. Is this true? I may have a job offer or I may go back to another school in a few months. My F1 will expire very soon and I don't want to go home and come back...

She did the change of status within the US
I guess one possible reason is that you did an unauthorized withdrawl from the school, which means that you're dismissed or you left without informing the school. In this case, you have to leave the US and reenter.

Please excuse me if I am wrong. This is the only reason I can think of. Good luck
