I came in here from africa in 2004 I have a 5yr multiple that expires the end of 2006. I have been in and out 2001, 2002 and then finally in 2004. Whiles i was here I went back b4 my 6months was up and came back in after 2 months. My wife is here on TPS and we have a baby. Now I applied for an extension online, and was granted stay for another 6months but they mailed the new I-94 7 days after it had expired to me. due to the fact that I have a new born baby who is a year old now I did not go back and I have overstayed for about 6months now. my father and mother both just got their green cards with the help of my bother who is an american citizen through the visa lottery.
How can I legalise my stay and be legit with the current ongoing debates on immigration bill? where do I stand?
Also Is there any way my wife can legalize(Green Card to Citizenship) since she is on TPS(tmporal protected status) from liberia. I am aware the baby would need to be 21yrs. to file on our behalf.
I'd appreciate any advice!
