Hi all, The U.S. Citizenship and Immigration Services website states that "individuals who are physically present in the United States ... may apply for asylum". Does that mean it's okay to enter the U.S. with a nonimmigrant visa for, say, tourism, and then apply for asylum, without jeopardizing my legal status in the eyes of the U.S. systems and regulations?

Absolutely. Thats how I had come. Usually they grant a 6 months stay on a tourist visa. Try to submit your case during that period so you wont be out of status.

You r welcome. Please do let me know if you have any other questions. Although I am not an expert nor an attorney, but I have dealt with this issue untill last year, when alongwith my family, I became a citizen. If you want, you can PM me.

Sorry, I forgot to tell you that even though a person can apply for asylum within one year from the date of arrival, it is recommended to file the case during the period you have been given at the time of entring the
USA.
