B2/F1- DS156 form need help pls

Need help...Situation is that i am canadian citizen and my parents are US permanent residents. They have filed I-130 for me.

I attend one of those Carribean medical school and our fifth semester + clinical rotations are held in US. I have just begun to look into immigration law as i need a visa right now and according to US immigration laws it seems that i may not be eligible for F1 due to that I-130 form (immigration intent).

All my hardwork upto now (plus 100K in debt) will be a waste if i can't get B2/F1 or J1. Am i really screwed up that big or am i just exaggerating. Can someone please help me here.

What if i fill out in DS-156 from Q.36 and Q.37 ---> that NO ONE have ever petitioned an immigrant visa for me and NO my parents are not in United states, respectively. Is there any way custom officers can find out.

Please help....I am really desperate and stressed out here.

Hi:

Please do not do anything foolish. They can easily track an I130 application, and then whatever chances you have are almost definitely gone.

Declare it and be prepared to show proof of return upon completion. No-one can vouch for anything, but proof of your educational work may very well work in your favor. Also bring plenty of ties to your country of current residence, be proof of residence, finances etc. The overall message your are trying to send is : "Yes, I have an I130 filed for me, but I do not plan to immigrate on THIS PARTICULAR TRIP. I have these obligations, X, Y, Z, which will demand that I return first after my rotation, before I can immigrate at a later point based on the I130 petition. "

first of all, I want to thank you for your prompt reply.

Now you see my situation is that I am a student and always been a student upto now. I have never entered workforce and currently I am in carribean islands. My parents are in US and we have no one except few family friends in canada. I don't have anything in canada. NO HOUSE, NO CAR, NO NOTHING. During my semester breaks, i usually go to US. My student loan is from US bank as well....So how should i prove to custom officers that i shall be going back to Canada after my education. I know this is not your problem and you might ask me to figure it out myself, but i am just looking for some suggestions my friend. I am honestly trying to tell you everything about my situation....pls give me some suggestions.

Without B2/F1 or J1, i can't do rotations or residency in US and the way it's setup here in carribean islands is that if i don't do my rotations, then i won't get my MD degree and overall i will be left with nothing but a HUGE, HUGE DEBT W/ Escalating interest.

I understand your situation. Unfortunately, there is no one who can give you a guarantee that you will get what you want. The only option you should NOT consider is lie about the I130 application.

With regards to the rest, you cannot provide something you do not have. Offer them WHATEVER ties to Canada you have, and ask them to adjudicate your visa petition. Incidentally, there are ways of presenting evidence in a more favorable light. Sometimes how you present yourself may also affect the decision. Have you ever contacted prospective employers in Canada? This is something you should mention. What will count in your favor is that doing a rotation in the US is something REQUIRED by your program - definitely have your med. school submit documentation testifying to that.

Other than that, the decision is in the hands of the consular official, and subsequently in the hands of the officer at the POE. There are no guarantees. That is just the nature of the beast.
