I was laid on Jan 04 2024 on H1B visa and before 60 days grace period ended, I applied for B2. Instead of B2 requested start date of Mar 1 2024 I wa given it from Jan 4 2024 instead. Post B2 I applied for B2 extension which is now valid till Jan 03 2025.
I was planning to move back to India this week but two days ago I got a job offer who will start with COS from B2 to H1B with premium processing.
Once LCA got certified and I receive H1B application receipt. Can I stay US post 3rd Jan (which is end of my B2 visa) legally with H1B receipt or do I have to leave the country and come back after H1B is approved?
