B1 Visa Extension..

Hi,

I wanted to know something.

A friend of mine has a B1 visa from a company in India and is in US currently. He is here for 3 months which will complete next month. However his current client wants him for another 3 months.

Now my question is does he have to go back to India to get the 3 months extension? Cant he not get the 3 months extension staying here? Can the India company extend his B1 visa by him staying here?

Any help on this would be helpful.

What are the dates on his stamp on passport.
What is the date stamped on his I-94

Here are the dates as you have asked:

His B1 is Valid till Aug, 2014
The current I94 is from December 19th 2005 to March 18th 2006

Since his I-94 expires in March he will have to either leave before that date or file for extension.

His best bet would be to work something out with the company he works for.

To file for extension he will use I539 with proper paperwork

His current company where he works for, I mean the client wants him for another 3 months. And his company in India is also ready for that. All they dont know is if he has to go back to India or can he file for extension from here.

So, who will do the I539 paperwork. The company in India (that holds his B1) or the client here?

And how early does he need to start this filing?

he can file here on his own, with the proper paper work from his company. But with the time constraint it might be better to go back and come again. he needs to file immediately
