B1 Visa and Immigration Application

Hi,

My husband's entire family (parents and elder brother who is married) migrated to the USA 7 years back. My husbands visa was rejected because he was already 21 years old by then and couldnot be considered as an dependent.

Ever since he has been rejected a visitors visa once.

Now his company plans to process his B1 Visa.
Meanwhile,his parents had sponsered him and his Immigration Application was in process in the USA.
But since then his marital status has changed and the application has not been renewed as yet.

I would like to know whether this immigration application can be a hindrance in him getting a B1. Will his visa be rejected again because of aforesaid reasons.

People at his company who are handling his B1 process are not sure about this. Hence please update me regarding the same at the earliest since he is almost scheduled for an B1 interview soon.

We donot want another visa rejection case as far as possible.

Plz help me out!

Persons who have shown immigrant intent become ineligble for visas that do not allow for dual intent such as B1/B2, F, and TN. Since your husband applied for a green card in the past, even though it was rejected due to age out, this is still clear immigrant intent. He has a very high chance of having difficulties obtaining such a visa, unless he can show that his green card application was denied, and he is not in the process of getting a green card at this time.

To avoid any complications, he must apply for a visa that allows for dual intent such as H1b, or L1.

The other option is he can try to show the green card denial notice when he applies for B1.
