B1 to H1B transfer

Dear Rajiv,

I had H1B and went to Chennai consulate in Feburary 2007. My H1B gets rejected my them and said that they will forward this case to INS and INS will contact with petitioner. Two months over no letter from INS. Now I have B1 with me. Can I fly to USA then apply from B1 to H1B status change. Does my case come under H1B cap?

Rajiv is a very big attorney and he will not answer for your questions. It is a forum and we just try to share info.

B1 to H1B is not possible easily. Also it comes under New H1B quota.

It takes more than 2 months or even 6 months to get letter from USCIS to your company about the H1B rejection at the Consulate. Once it is rejected, it is very difficult to appeal for it.
