Sorry for being a bit off the topic. But I would greatly appreciate your inputs gurus!!

My father came here on July 16th 2003 and he was given 6 months to stay (till Jan 16th 2004). We applied for his extension on Dec 17th 2003 (one month before the expiry of I-94). At the time of application, we had sent his original I-94. We received a receipt notice and the check we had sent had been encashed too. The website was saying that it was taking 30 to 60 days to process and now it reads 60-90 days (Yeah, VSC obviously!!) Now, my father wants to travel to India immediately. I can withdraw his I-94 but I think the date stamped will still be Jan 16th. Will this be counted as overstay?

Should not be a problem

As long as you have a receipt number for a pending case of extension of stay, your father should be fine and it is NOT an overstay. I have know cases in the past where the case got approved after 8 months, by then the parents would have completed 1 year (additional 6 months extension) and left home.
