b1/b2 visa AOS with DV 2012

Dear all,

After 14 years I finally got my WIN in DV 2012 :))))
I am member on this forum since 2005.

I am currently in US on 10yr b1/b2 visa
from: Mart 12 2011
to: September 11 2011

Also I just got wife here in US and she is on F1 visa until Mart 2012

I don't know if there is a chance to try AOS or need to come back to my country. I prefer AOS but please tell me your opinion.

I have also a B1/B2 VISA valid until 2017, but as far as I know the maximum you can stay in the country whit this type of VISA is 3 months each entry, and a maximum of 6 months per year....

AOS is only possible if you extend your B-1 stay via I-539 to your priority date (October 1 is the earliest, the exact date depends on your case number). I'd suggest you go though CP.

B1 visa extension can be problem because there is intent of stay. :(

My case number is 00028xxx
 
The 2012 DV lottery doesn't begin until October, so you will be out of status. You need to either extend your B1 (risky) or do it in your home country.
