B1/B2 Parents got refused/rejected twice

Hi,

My parents visa cancelled twice.

REASON: Potential Immigrant.

Having tough time. Whom should I contact regarding this.

I have been staying here from past 8 years.

First time in 2003 Mar,
Second Time in 2005 Nov,
Third : They are applying in Sep 2006.

Want to take some precautions/Actions this time. Please provide your help.

Please Assist.

I'm sorry to hear that ! Maybe going thru an agent might help, on the forums i saw someone who posted even a contact name, address and phone no of a person who takes care of visa's ofcourse for a fee !

The problem is that sec 214 of INA states


# every applicant shall be presumed an immigrant until he/she satisfies the consular offier that he/she is not#

The main reson for denial is not being able to prove strong family ties to homeland

My son recently got denied B visa for this reason as mother and brothers are all LPR living in the USA

You need to show strong ties to home. Property, business, source of income etc. This has been discussed numerous times on this forum, and every case is different.

Contacting Senators / congressmen DOES NOT HELP. Their offices get requests for letters on a very regular basis and it is easy to get one .

Consular officer’s decisions cannot be challenged in any US court. Their interpretation of the law can, however be investigated by the Dept of State.
I am in the same boat , and my parents have their interview in Dec . I also saw someone in this forum whose mother was rejected 5 times before a B2 was issued for 10 years .

It is all about prepration for the interview, confidence in answers and strong reasons to visit the US .
