I am currently on an H1-B visa on behalf of a Software company 'A' and working in USA for the past 3 years. I am
a Graduate in Commerce ( B.Com) + 1 Year PG Diploma( University)+ 1 year PGDCA (Private Institution) with 6 years
experience in this area. I am appying for LCA through Company 'B'. The Job requires 2 years experience but does not reqire any Degree.

Will there be any problem at LCA level or at I-140 Level.

leo123,

Allow me to correct you. LCA is for H1b Visa and gor GC it is LC.

You should be able to file definitely for EB3 (to my understanding) - but get a good lawyer before you proceed.

If lawyer is good then LC should not be a problem. I don't think if LC is cleared - then you will face problems in 140 level due to your degrees etc.

Also since you could get H1B - it should not be a problem to get EB3 done for you - more or less - as H1b criteria of 16 years of study is fulfilled and certified in LCA. But still LC is little different - so get a good lawyer for better chances.
