I have an I-140 approved for consular processing in Oct. 2001. I had my I-140 approved with Employer A on H1 visa.

Immedieatly I had to change my status to O1 visa through employer B. Now I currently hold an O1 visa since Oct 2001.

My questions are:

1) Employer A agreed to give me an employment letter if I wished to pursue the green card. Would it impact if I am applying for CP after such a long time?

2) How would the case be treated as I currently hold an O1 visa and I am pursuing CP on an older H1B?
 
If I understand you correctly,

You are not working for the sponsoring employer anymore- nor are you likely to join them after CP. You could face some tough questions-especially regarding the reason why you are not working for your sponsor NOW. If you have a valid employment letter and are prepared to answer the consular official's questions, your case has a good chance of success even with its shortcomings. You should be able to prove beyond doubt that you will work for the sponsor when you come back and also that the job offer is genuine. Good luck.;)

thanks for the reply. you have raised a very important question about proving beyond doubt that i would be working for the sponsor after green card approval.

here are a few of things i would like to clarify on the same lines.

1) How would i strongly prove that i would be working for my green card sponsor company?

2) How long am I legally entitled to work with the sponsor after the green card?

3) Here are the logistics:
I used to work as an employee for company A (my H1-B and green card sponsor) and as a contractor for company B ( my current O1 visa sponsor).
The agreement after green card approval is to work for company A as an employee and as a contractor at company B for a certain amount of time, let us say 3 - 6 months.
