I worked in US for almost six years(when my H1 limit was about to expire) and returned to India in May 2002. I kept away from US for year and half and attempted to get a B-1 Visa in Sept 2003. I was rejected on the grounds of 214(b). Prior to that I didn't know what is 214(b) and no idea how the officer got the idea that I am not gonna come back. I guess he just ignored to look at the history of my earlier Visa.
Now I am going for H1 Visa sponsored by a medium sized American Company. I am not sure if my rejection in Sept 2003 is going to affect this time. I read in some FAQ that H1 Visa is immune to 214(b). Anyone having experience on overcoming 214(b) refusal and what documents will make them believe that I am not gonna settle in US.
