Hi folks,
I have a Masters degree in Computer Science from U.S. My labor cert is in process in the regular category with a priority date of December '03. I've completed 4 years on my H1-B. My company which is a genuine American firm (where I have my Labor cert filed) got recently acquired. I don't know how committed the new company is w.r.t processing my Green card to completion. Should I move to another company (say, a DESI company) and file under the PERM category (thereby losing my priority date) or should I just stick to the existing priority date with the current company and take my chances with them?
Alternatively, I can refile using PERM with the current company (if they agree to do so which I don't know yet) and also retain my priority date (by making sure that the new labor cert application is similar to the old one word to word). But, since I started my work career with the company that got acquired, I don't think I stand a chance (as I didn't have any prior work experience before joining the company.
Any advise from you pros would be really appreciated. I'm terribly confused and I'm not sure what action I should take. I'm also nervous about the possibility that my inaction might land me in more trouble.
