awaiting 485 approval. Company merger. Spouse (on H4) in India

Hi Ciba, All,

My wife is in India and my company is getting bought out.

Can my wife use her current H4 to come back. She\'ll be coming back only
a couple of months later. Do you see any problems?

What happens when the company is merged. Do I need to resubmit I140 or
anything.

We\'ve got our Advance Parole, but we wanted to continue the H1/H4 status.
Any advice?

What do you mean by "wife comes back only a few months later"?
She can certainly come back using H4 (that has nothing to do
with company\'s merger!).

As for the merger, I am not sure, but from my understanding,
you will be fine since your I-485 has been pending for 180
days already. You are covered by AC21.

Sorry for not being clear earlier.

My company will announce the merger next week.

My wife plans to come back in september (using her H4 visa stamp,
now of the "old" company).

I would not have completed 180 days as my RD is 4/13.

Do you see issues here?
