My lawyer sent in my and my wife's I140/I485 application yesterday.
However, he mentioned at the last moment that my wife's birth certificate will cause an RFE to be issued. I had procured my wife's birth certificate from the Chicago Indian consulate and apparently that doesn't help.
The papers have been mailed in at this point. I was reading through the discussion groups and found out that getting an RFE issued can be a pain.
My wife's original birth certificate is in the native language and does not include her mother's name. Can I mail in my wife's authenticated birth certificate (including affidavits) at this point and thus avoid an RFE? Or is to too late?
Secondly, since my wife's I485 is based on my I485, will an RFE in her name impact my I485 in any manner?
Any preventive help in this issue will be of tremendous help.
