AVM is not always updated

I have experienced that the AVM messaging system is not updated correctly. My and my wife\'s 485, AP and EAD were mailed on April 20 (RD 04/23). For the longest time, no receipts. Finally, we received the receipts (June 20) and could start checking the AVM.
I was pleased to finally hear that my wife\'s AP was approved on July 13, and a couple of days later, the letter from INS actually arrived. In the envelope was my wife\'s AP, and also my own AP. But to this date, the AVM had not been updated.
Today, as you all can imagine, was a happy day, as we could walk into the SF INS office and demand our interim EADs, which we also received of course, only bad thing is that the EAD cards are only valid for 3 months. But this is to be excepted and it is only part of the abuse.
Important thing is that things are moving forward. Now, next important date is 3 months ahead, the magic 180 day limit.....

We are in pretty the same boat. Our application was mailed on 04/19 and got RD 04/23 and ND 06/21. On 07/19 we received AP for both of us but the AVM has not been updated yet so far. That\'s weird.

We are going to get our interim EADs in SF this week so buddy, your info is very helpful :-) It\'s so good to have somebody doing that ahead of us and sharing with us everything.

Why do you need to apply for intermi EAD?

Is it that your H1 is expiring?
Any specific advantages in applying for interim EAD.

Buddy, buddy, are you married?

I\'m married and my wife is on H4 which prohibits her from working. According to current rule she even doesn\'t qualify for a social security number (the thing was very easy in the past). So we need the card for her to get everything up. So generally if you have a spouse on a non-immigrant status without work permit EAD will be his/her relief. With EAD he/she is even freer than you on working without restriction. The new law permits L2 people to work. H4 can\'t and F1 can work with strict restriction. Most of derivative applicants who are in US fall in H1, H4 and F1 category. If both of you are H1, EAD may not be that attractive, AS LONG AS your H1s are not expiring.

I am in a similar boat.

RD 04/30,
AP on July 20th.

I\'m going to SF soon to get my wife and I
a EAD card.

Two differences are:

a) She got a social security number (we arrived at
end of 98) (of course it\'s stamped no valid for work).

b)The AVM is/has always been updated for our cases.
Maybe it is because we go through a large Immigration
Law firm.

H4 can get SSN (Social Security Number)

I am surprised to hear that your wife on H4 does not have a SSN. For us, it was necessary in order to do our tax return. It is also needed for drivers license.

We have had all kind of problems with the Social Security Office, they are pretty much behaving like INS and treating immigrants very badly.

The problems have been that they did not want to issue SSN cards to my wife. Even when DMV office requested her to provide SSN she could not get a SSN card, as the social security office argued that the DMV office had already by mistake issued a drivers license to my wife without the SSN. They wanted her to get a document from DMV that showed that my wife had to get a SSN in order to get a drivers license. The DMV could not give such a document as she already had a drivers license. Still, they wanted her SSN..

As I remember it , it came down to that in order for them to issue the SSN, she would have had to have DMV cancel her drivers license and then reapply for a new drivers license in order to be able to show that she needed a SSN for her drivers license. (This would in turn have driven up our car insurance bill, as the premium is based on how long you have had a US drivers license.)

It was insane.

Finally when she months later went in and said that she needed SSN for taxes, the card was issued without arguments.

The last thing that happened was that they refused to change my wife\'s SSN card to one that is valid for work with the proper work authorization. The reason was that the interim EAD card only is valid for 3 months. (See my other postings about this).

Finally after a couple of hours of arguing they gave in, and issued a card but they put some special restrictions on it. It will be automatically cancelled in October if my wife does not appear at the social security office and shows a new EAD card.

I think this is illegal as hell, it is discrimination against immigrants, and it will for sure make it more difficult for my wife to find work.
