Automatic Visa Revalidation question.

Hello All.

I'm planning to travel outside the US on vacations.

My current status is as follows:

-Mexican citizen
-Currently I'm on my 7th year H1-B extension ( in fact I received the approval letter last month)
-My H1-B passport stamp is EXPIRED.
-My I-485 has been pending since 9/03.

My lawyer told me that there is NO need to re apply for a visa stamp and that I could re enter the US using "Automatic Visa Revalidation" showing only my H1-B extension receipt, I-485 receipt and EXPIRED visa stamp.

Has anybody travelled under similar circumstances? Is there any risk? has anybody had a bad experience?

Thanks.

travel outside of US

did you applied Advance Parolle or not?

from my understanding you can't travel outside of US without AP

Elena

ecuellaro,
There is no way you can re-enter without a valid Visa stamping in your passport unless you have a valid 'Advance Parole'.
