automatic revalidation question

Hi,

Myself and my wife are planning to travel to Canada next month.

We have not left the country since we came here in 2001. I have an old I-94 (white form) stapled on my passport and so has my wife. Both the stapled I-94 and the visa stamp on our passports are expired.

We both have new valid I-94s. I entered the US on H-1 and am still on H-1. My wife entered on H-4 and now is on H-1.

We would like to get our visas automatically revalidated since we are traveling to Canada and will be in Canada for less than 30 days.

I wanted to know:

a. Are there problems in doing this?

b. If the officials take away the I-94, is that a problem? I have not attached our valid I-94s to the passport (it is still with the original I-797) so they probably will not take it away. But if they take away the original white I-94 (which is expired), is that a problem?

The automatic visa revalidation stopped since April 2002. you can either send for revalidation here to St. Lousi or get appointment at consulate in Canda for stamping. Since ur wife had H4 stamp and is now on H1 she definitely needs a new stamp from abroad, no revalidation for her

U need to keep both I-94's attached to the passport.
 
State dept has not officially stopped automatic revalidation. I know for H1 u can still try to use automatic revalidation if 1) u r returning from canada within 30 days 2) did not apply for a visa in canada during this period 3) ur not national of one of seven countries listed on state dept website 4) have not travelled to any other country from canada 5) intend to get back to your current I-94 status 6) Have valid(not written cancelled withput prej) expired visa stamp in PP.


But again this is just a rule listed . U need to find out of practical cases .
