Can any body tell me the details regarding the automatic revalidation rule?
My visa status in USA is H1 and my current I-797 expires in May 2007.My H1 visa on passport has expired long back in 2005.I'm going to Canada this weekend and coming back to USA in 2 days. Is there any link in USCIS site for this?

Per my understanding, I need these following documents

-Current Original I-797

-Reference letter from the company saying I'm working there

-Current I-94 (Which comes attached along with the I-797)

Please let me know If I need anything else.

Thanks

I don't think such a thing as automatic re-validation exists. You would need to get your passport visa restamped to be able to re-enter the US. You should talk to a knowledgable immigration attorney urgently before you make this trip.

First you need to get an appointment at US counsulate @Canada.
Then you need to get visitor visa to enter into Canada for the appointment dates

As for as document goes
i-797
passport - copies
employment letter
pay stub
DS 157 forms -
I94
All documents that you submitted for visa extension - like offer letter, education evaluation etc -This is not a must, but having it handy is fine.

There is also a risk involved by doing this. If your visa gets rejected, you cannot come back to US, you need to travel to your home country from Canada.

One of my friend(muslim) got stuck in Canada for 2 months - FBI name check. So he had to stay there for 2 months and do a lot of followup with immigration authorities to get his visa stamped and clear the FBI check. This is just an exception though. A lot of other friends, had no problem going to canada to get their stamping.
