Hi Guys

My friend\'s I485 was approved last week and got his approval letter on Friday 05/24/02.

I have only this info.

BTW, could you please find out from him whether his I-140 is approved for CP or AOS. I think this information can be get from his I-140 approval notice.

Based on Abhay\'s information, my guess seems to be correct. All employment based GC filers, whose I-140 was approved for AOS are getting approved first without any wait, compared to those whose I-140 approved for CP and applied for AOS here. I think this I-140 may be requested by one of the officers from the concerned dept of INS. As most of us have our I-140 unknowingly approved for CP, our files would have been gone to respective consulates ie. Madras consulate or Bombay consulate etc. Officers may request the consulate to send those files which will take a while to come here and from mailroom come into our files and hence results in late approval.

Another guess is that, as our files move different shelves in INS, one of the person\'s work in INS may be just to check whether all the necessary documents exist in a I-485 filers file. If they come across such I-140 CP issue, they may put this file on different shelf and thus on one day they may sent a request to consulates for a bunch of I-140 files. After recieving them, (everyone knows about our INS mailrooms)these files may go to respective person\'s files which may take a while and then will be checked and finally assigned(may go to differnt shelf who knows). After assigning, the officer may then go into detail scrutiny of the filer and particulars(eg. out of status issues etc.....)

Bottom line is whenever INS is starting a new month approval, the first few approvals seems to be having I-140 approved for AOS. Hence my guess is that people before August 2001 RD who are still waiting, may come into this "I-140 approved for CP" group.

Any comments are appreciated on my guess.

no news yet, spoke 2 iio on 5/23/2, and she says it will take 45-60 more days. i told her, thanx 2 the ins delays, i cud not take my wife 2 canada 4 our anniversaery, cud not refinance my mortgage, and hav had my life disrupted. wen i came here, i was alone, and now i hav 2 sons who r us citizens, but i am not. this sucks!

Why can\'t you refinance a mortgage? The bank gave me over $200k on an H-1B. The fact that I had filed AOS to them was irrelevant. If you\'re in H status, you can visit Canada and re-enter without AP.

I don\'t mean to minimise your plight. We\'ve all had setbacks on the way, some bigger than others. But I\'m unsure as to why you are unable to do these things.

If you have I-140 approved for AOS(not for CP) and then your filed your AOS(I-485) here, then, I expect your approval before my approval though my RD is Aug 15th 2001 and unfortunately my I-140 is approved for CP.

Let\'s watch.Don\'t rely on IIO\'s information. It is 98% faulty information.
