Hi Gurus:

I have checked the online case status today.

I have the following message:

"A written decision in this case was mailed on October 17, 2002. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please speak to an Immigration Information Officer during business hours."

What does this means?

MY RD : Aug, 2001

Did anyone had similar message and know the result.

Please help.

That doesn't look too good - you should contact yr. attorney immediately and have him speak with the IIO.

This very serious, It could be an intend to deny

Only problem I can think of is I-40 was approved for CP but filed AOS.
 
I had two I485s simultaneously !

My lawyer sent out my I485 application to INS, one day before my Priority Dates got current. ie my RD was 6/29/2001 (Dates got current from 7/1/2001). When I got this to his notice, he wouldn't admit his mistake. After I showed him a few cases denied on the same basis, he agreed to refile. In Feb 2002, I filed for a second I485. I got a RFE for paystubs (as my company had merged with a European company in the meanwhile) and explanation for 2 I485 applications. After I sent the RFE reply, I was approved / denied within 4 days. (I got a denial notice for the first one and a approval notice for the second one together). Even today, I have the same message for the first one : "A written decision ..........". Hope this helps.

I got RFE in July 2002. At that time, the message changed to the following : " .....additional information has been requested". Once my lawyer sent the paystubs, W2, employment letter and a letter explaining the 2 I485 apps, I was approved in 4 days. After that, I got 2 envelopes from INS after another 3-4 days. One of them had an approval notice for the second one. While the other had a denial notice for the first one, giving me the reason for denial (applied before the dates were current.....). Also, the denial notice had a note in the end saying that they had approved my second application. It will also say if you can appeal your case or not and if yes, then in how many days.
I would suggest to contact your lawyer and ask him to call INS to find out more about your case. I wish you all the best. Let me know if you need any other details.
