swas,

The bulletin was indeed very disappointing. I am afraid the worst is coming true. For now EB3 India can pretty much forget about the September bulletin. The bulletins from Oct to Dec 06 will give us some idea of what to expect in the fiscal year 07 (begins in oct 06). Currently people are stating that there might be further retrogression in Oct 06. I don't see India EB3 dates going further back from April 01 but my fear is that they may get stuck there for a long time if there is no CIR or other favorable bill. The worst case scenario is that India EB3 gets stuck in April 01 for the entire fiscal year of 07. I hope this doesn't happen but anything is possible at this point.

If we get lucky and 245is don't flood the system and the DOS and USCIS find that there aren't to many India EB3s in the remainder of 01 then we may see dates move from Oct 06 but they may move weeks at a time. That is the best case scenario.

The bottom line is that no one really knows what is going on and its almost useless to speculate. I am preparing myself mentally to wait for atleast another year. There is nothing else I can do ..

Saras! Your thoughts about EB2 India?

Saras:

For the last 3 months or so there have not been an advance in EB-2 India dates even a single day. Prior to this each month the dates in this category were advancing 4-6 months. In the visa bulletin for August, this category is now listed as Unavailable. What does this imply. Do you think, that we will see an advance in dates for EB-2 India in October. Appreciate your reply.

I agree with your analysis.

EB3 is flooded.

Hate to say this but, EB3 will not move untill November.

also, It will be interesting to see where EB2 falls back from unavailable. That should happen in Nov Bulletin.

ab kya karun,

I think the EB2 situation will be better come Oct 06. 245is will not pressure EB2 because they are all either Family based or EB3. I think the dates for EB2 India will start moving from Oct 06. The extent of the movement depends on how many EB2s are pending. However with retro in place India EB2 will only get 2800 visas for Fiscal Year 2007. There may be some spill-over from other categories if they all become current but this whole spill-over of unused visas is not very clear at this point. I personally think India EB2 will move a few months at a time after Oct 06 and future progress will depend on demand. I don't think anyone knows the true extent of the demand.

saras

I can see EB2 will becoming worse pretty soon. Everyone I know filed In Eb3 are pretty much filing the second under EB2. i am in the process too. If we pushed EB2 date back, we are sorry about that. But we have pretty good pd. Life is simply harsh.

Harakad,

With a PD of April 30 2001 I think you might be okay by the end of this year or early next year. They may move the dates to 1st of May or something towards the end of this year and the dates may get stuck there. I think you are in a slightly better position than us late 2001 filers.

regards,

saras
